Former Marine accused in NYC subway chokehold death out on bail

Daniel Penny, a 24-year-old Marine veteran, has been released on bail after being charged with second degree manslaughter in the death of Jordan Neely, a 30-year-old former Michael Jackson impersonator who was homeless. Neely died after being put in a chokehold by Penny on a New York City subway train earlier this month. Neely's family attorneys supported the charges but said Penny should have been charged with murder and arrested sooner. Penny's attorneys said he acted to protect himself and his fellow New Yorkers and expect him to be "fully absolved" as the case moves forward.
