Marine veteran charged with manslaughter in Jordan Neely subway death to surrender

Daniel Penny, a US Marine Corps veteran, is expected to surrender to authorities on a manslaughter charge for the death of Jordan Neely, who he kept in a chokehold on a New York City subway. Neely's death has raised concerns about how those with mental illness are treated by the transit system and the city, as well as crime and vigilantism. Penny's attorneys have previously said he acted in self-defense. Neely had been dealing with homelessness and mental illness and had several arrests to his name. A second-degree manslaughter charge in New York requires reckless conduct that creates an unjustifiable risk of death and a gross deviation from how a reasonable person would act in a similar situation.
