Controversy Surrounds Subway Chokehold Death of Homeless Man

Marine Daniel Penny's lawyers argued that he acted in self-defense when he placed homeless man Jordan Neely in a chokehold on a Manhattan subway, leading to his death. They claimed that Neely had a history of violence and erratic behavior due to untreated mental illness and was threatening Penny and other passengers. Neely's death was ruled a homicide due to compression of the neck. Penny has not been charged with murder, and a grand jury could be called next week to determine whether to bring down an indictment.
