Planned Parenthood Drops Kentucky Abortion Ban Challenge as Woman Loses Baby

Planned Parenthood and the ACLU have dropped a class action lawsuit challenging Kentucky's near-total abortion ban after the named plaintiff, Jane Doe, lost standing to bring the case as she was no longer pregnant. Kentucky's Supreme Court ruled earlier this year that abortion providers cannot bring challenges to abortion bans on behalf of their patients. Doe's lawsuit sought to get around this by having a pregnant woman sue on behalf of a class. The lawsuit challenged two laws, one banning abortion after a fetal heartbeat is detected and another banning abortion at any time, both without exceptions for rape, incest, or fatal fetal anomalies.
