Republican-led legal challenges target Biden's border policies.

The Department of Justice under President Joe Biden is defending the Trump administration's policy of separating migrant families at the US-Mexico border, including arguing that the separations were done out of "perceived humanitarian considerations." The DOJ is fighting back against five asylum-seeking mothers who are suing the federal government for the trauma they say they and their children suffered because of the separation policy. The DOJ has also questioned the families' ability to seek monetary damages through the Federal Tort Claims Act. The separations were part of Trump’s broader “zero-tolerance” policy, which resulted in the separation of more than 5,600 children from their parents in 2017 and 2018.
