Judge Allows Teacher Shot by 6-Year-Old Student to Sue School District

A judge has ruled that an elementary school teacher who was shot by her 6-year-old student can proceed with a $40 million lawsuit against the school district in Newport News, Virginia. The district had tried to block the lawsuit, arguing that the teacher should only be eligible for workers' compensation. However, the judge determined that the teacher's injuries did not arise from her employment and that being shot by a student is not a workplace hazard. The trial is scheduled for January 2025.
