DOJ Opinion Mandates Statewide Reporting of Undocumented Immigrants to Protect Welfare Funds
The U.S. Department of Justice has issued a new legal opinion requiring all states to report known undocumented immigrants to the Department of Homeland Security as a condition for receiving federal funding for Temporary Assistance for Needy Families (TANF) and Supplemental Security Income (SSI). This ruling supersedes a 1998 interpretation that limited reporting duties to specific agencies, now binding entire state governments. Non-compliance risks the loss of over $16.4 billion in annual federal aid. The policy applies prospectively, meaning it does not affect past enrollments, and is expected to trigger legal challenges from states that refuse to cooperate.
