Lawyers seeking to revoke the FDA's approval of mifepristone, an abortion-inducing drug, are using the lawsuit to appeal to U.S. District Judge Matthew Kacsmaryk to revive the Comstock Act of 1873, which banned the mailing of anything related to contraception or abortion. Anti-abortion groups want Kacsmaryk to affirm that Comstock is good law and can be applied broadly, not just to unlawful abortions, as the Department of Justice under President Joe Biden has posited. If Kacsmaryk revives the law, it would open the floodgates for future litigation and make it very difficult to operate an abortion clinic or to be an abortion provider.
