Family Sues After 'Widow Maker' Tree Collapse Kills Father at Austin BBQ

The family of Kirk Foyle, a Texas father of four, filed a lawsuit against Green Mesquite BBQ and nearby property owners after a diseased pecan tree the complaint calls the 'Widow Maker' collapsed onto him while he was dining outdoors in Austin, killing him. The suit accuses staff of gross negligence for failing to inspect, maintain, remove, or warn about the dangerous condition despite visible signs of disease, and seeks at least $1 million in damages for death, mental anguish, and costs. The incident occurred May 19 during storms at 1410 Barton Springs Rd.

Evan Wasserstrom, a man from Los Angeles, survived eight "widow-maker" heart attacks, which are usually fatal. He experienced a complete blockage in his left main coronary artery (LMCA), causing his heart to stop beating six times in the ambulance and twice more in the hospital. Placed in an induced coma, doctors were unsure if he would wake up or regain his ability to walk and talk. However, when life support was unplugged, Wasserstrom miraculously recovered. Widow-maker heart attacks are rare and typically affect individuals over 45 years old. Only 12 percent of those who suffer the attack outside of the hospital survive.

Former City of Toronto official Brad Ross survived a "widow-maker" heart attack and is warning others to take care of their heart health. A "widow-maker" heart attack occurs when the left anterior descending artery (LAD) is completely blocked or has a critical blockage. Symptoms can include shortness of breath, dizziness, fatigue, heartburn, abdominal pain, and pressure, tightness, pain or a squeezing or aching sensation in the chest or arms that may spread to the neck, jaw or back. Risk factors for heart disease and stroke include smoking, high blood pressure, high cholesterol, lack of exercise, obesity, and diabetes. Up to 80% of premature heart disease and stroke is preventable by eating a healthy diet, being physically active, limiting alcohol consumption, and not smoking.
