IRS Proposes Revoking Tax-Exempt Status for Schools Using Race-Based Criteria
The IRS has released proposed regulations that could revoke the tax-exempt status of up to 18,000 private schools, universities, and trade institutions. The rules target institutions that use race, color, or national origin in admissions, scholarships, or other programs, citing a new nondiscrimination standard. While religious schools retain the right to select students based on faith, the move follows the 2023 Supreme Court ban on race-based affirmative action and intensifies the administration’s conflict with major universities like Harvard. The proposal allows a 60-day public comment period, with final rules expected to take effect for tax years beginning after May 31, 2027.
