5th Circuit Rules No Federal Right to Clean Water Exists
The U.S. Court of Appeals for the Fifth Circuit has definitively ruled that the U.S. Constitution does not guarantee a right to clean drinking water or truthful information from officials during public health crises. In a September 4, 2026 decision, the court upheld the dismissal of a 2022 lawsuit filed by four Jackson, Mississippi residents. The plaintiffs argued that the city’s failure to address lead contamination violated their 14th Amendment right to bodily integrity. Judge Kurt Engelhardt, writing for the majority, stated that while the harm was 'grievous,' it did not infringe upon any 'deeply rooted constitutional right.' The ruling closes the federal constitutional avenue for these plaintiffs, though it notes they may still pursue tort claims or political remedies.
