SEC and CFTC map securities rules to crypto assets with new joint interpretation
The SEC, in a joint interpretation with the CFTC, clarifies how federal securities laws apply to certain crypto assets and transactions, provides a token taxonomy for categories like digital commodities and digital securities, explains when a non-security crypto asset can become (or cease to be) subject to an investment contract, and covers application to airdrops, protocol mining, staking, and wrapping; the goal is to give market participants clearer rules and will be published in the Federal Register.
